The Board of Zoning Appeals (BZA) is a board of five town residents appointed by the Circuit Court of Prince William County, on the recommendation of the Town Council, to serve five-year terms. The Board’s primary duty is to hear and decide on appeals from any order, requirement, decision, or determination made by the Town’s Zoning Administrator or any administrative officer in the administration or enforcement of the Town’s zoning ordinance, Chapter 157 of the Town Code. Sections 33.20-33.31 of the Town Code further address the structure, activities, and duties of the Board of Zoning Appeals.

The Occoquan Board of Zoning Appeals generally meets at least once a year in January for its annual organizational meeting at the Occoquan Town Hall. In addition, it holds special sessions on an as needed basis to hear appeals brought before it. Notices of meetings are posted in advance on the Town’s website below, at the Occoquan Town Hall and the Occoquan Post Office.

Appeals to the Board

An appeal to the Board of Zoning Appeals may be taken by any person aggrieved or by any officer, department, board, or bureau of the town affected by any decision of the Zoning Administrator or from any order, requirement, decision, or determination made by any other administrative officer in the administration or enforcement of VA Code §§ 15.2-2280 et seq., or Chapter 157 of the Town Code.

Any written notice of a zoning violation or a written order of the Zoning Administrator shall include a statement informing the recipient that they may have a right to appeal the notice of a zoning violation or a written order within 30 days, and that the decision shall be final and unappealable if not appealed
within 30 days. The appeal period does not commence until the statement is given.

To make an appeal, the aggrieved must file, within 30 days after the decision, a notice of appeal with the Zoning Administrator and the Board of Zoning Appeals, which shall include the grounds of the appeal as well as the relevant fees as contained in the current fee schedule.
